17 APR 2020 Dmitry Medvedev supported the extension of the dacha Amnesty before March 1, 2021 issued instructions for the preparation of the draft Federal Law.
What it is
The phrase "dacha Amnesty" is not an official term, but a colloquial designation of concessions from the state to owners of land and buildings during the registration process last. Her story began in September 2006 with the aim to encourage citizens to design the existing property, and the procedure itself is concerned:
- the land (cities, towns, villages) under individual housing construction (IZHS) and the available homes.
- of the facilities subsidiary or country economy;
- garages, additions and small buildings (vacation houses, bathhouses, sheds, etc.).
The ability to take registration under the simplified scheme given to citizens who have become owners of the above facilities until October 30, 2001 in the possession of:
- the undisputed right of ownership;
- membership owner SNT/of the cooperative, which purchased the site;
- documents on the law of the land which do not indicate their ownership.
The eponymous "Law on dacha Amnesty" officials never adopted, and the provisions of the procedure are reflected in two legislative acts subsequent thereto amendments:
- No. 191-FZ "About introduction in action of the town planning code of the Russian Federation" dated 29.12.2004.
- No. 218-FZ "On state registration of real estate" from 13.07.2015.
Initially dacha Amnesty was planned 5-year validity period but it was extended three times (up to 2010, 2015 and 2018). And each time we changed individual conditions of registration. All the years of existence in the USA of such a mechanism are already decorated more than 10 million registrations. But people are still not taking advantage of this opportunity, information about whether the extended dacha Amnesty until 2021, remains relevant.
New amendments and terms
Dacha Amnesty in the USA and the Crimea has been extended once again through the adoption of law No. 36-FZ of 28.02.2018 "On amendments to certain legislative acts of the Russian Federation". The latest amendments to that act before March 1, 2021, include:
- for commissioning and technical accounting (including the issuance of registration certificate) of the buildings of the individual housing construction is not necessary to present the corresponding building permit (article 8 paragraph 4 of law No. 191);
- for the procedure of state registration or cadastral registration of apartment houses, located on garden, country, home gardens or those that are intended for individual housing construction, the applicant will need a technical plan of the construction and proof of ownership of the land with located on it the building (if such data do not exist in the egrn) (article 70 part 7, of the Federal law №218);
Important! Preparation of technical plans within the competence exclusively cadastral engineers. To do this kind of work can only specialists with a resolution of SRO, which can be checked through the website of Rosreestr.
- the regions have the right to determine the maximum rates and charges for cadastral works (for example, drafting of technical plans) is not above the specified level. It must protect citizens against price hikes, but nobody can guarantee the absence of requirements for additional charges "envelope".
How to register
To legalize existing property in the period of "dacha Amnesty", it is enough to apply before March 1, 2021 at the office of Rosreestr or MFC with:
- A document confirming the right of ownership of land. For this purpose, suitable contract of sale, the document on inheritance or lifelong use, etc. (regardless of the year of issuance, but subject to then applicable laws). In the absence of such should contact your local authorities for an extract from the economic book or to buy land.
- The technical plan of the building.
- A receipt for paid state duty (the amount is 350 rubles).
- Statement, the passport and social security number of the applicant.
Note! The documents can be delivered individually or send it by mail. But in the latter case, you will need to make a pre-certification of your signature by a notary.
Pass the registration procedure and without the "dacha Amnesty", but should be prepared to certain difficulties and additional costs. For example, you must have permission to object input in operation from the day which can be obtained in the presence of a building permit. Latest real estate time of the USSR simply was not registered, so to prove their rights in this situation will have in court.
Even the fact that dacha Amnesty requires a minimum of documents, and its term was extended until 2021, stops many USAн the procedure of registration of their property, due to a possible lot of paperwork and unwillingness to pay taxes. But keep in mind that not properly executed, as appropriate, buildings and sites it is impossible to make any transactions: insurance, donation, sale. They sooner or later will be under the attention of the Federal service for state registration, and without registration of property rights can be viewed as a squatter and land – as the squatting. Besides the avoidance of registration is a false economy regarding taxes, since the detection of the object may have to pay a fine or even land tax in the double size.
